General Sales Terms and Conditions


Article 1: General provisions


The e-commerce website of ILC, an NV with registered office at Leegaardsdijk 8, 8400 with VAT number BE0765275461, RPR Oostende, offers its customers the opportunity to purchase the products from its web shop online.

 

These General Terms and Conditions ("Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order via ILC nv's webshop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional conditions of the Customer are excluded, except when previously, in writing and expressly accepted by ILC nv.

 

Article 2: Price


All prices listed are expressed in EURO, always include VAT. It does not include any required duties or taxes that the Customer must bear in the country of delivery.

 

The specified price refers solely to the articles as set out in writing. The accompanying photos are intended as decorative and may contain elements that are not included in the price.

 

Article 3: Availability


Despite the fact that the online catalogue and e-commerce website are assembled with the utmost care, it is still possible that information may be incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the product selection are not binding for ILC nv. With respect to the accuracy and completeness of the provided information, ILC nv is solely bound to obligation of means. ILC is in no way liable in event of obvious material or printing errors.

 

If the Customer has specific questions about for instance sizes, colour, availability, delivery terms or method, we ask the Customer to contact our customer service department in advance.

 

The product selection is valid while it is part of our Collection and may at any time be changed or withdrawn by ILC nv. ILC nv cannot be held liable for the non-availability of a product. If an offer is for a limited duration or subject to conditions, this will be explicitly stated in the offer.

 

Article 4: Online purchases

The Customer may choose between the following payment methods:

  • VISA, Mastercard
  • Maestro
  • Bancontact
  • iDeal
  • Paypal
  • Apple Pay

ILC nv is entitled to refuse an order pursuant to a serious breach on the part of the Customer with respect to their orders.

 

Article 5: Delivery and execution of the agreement

Delivery occurs by Mikropakket for delivery to the countries Belgium, The Netherlands and Luxemburg. Deliveries to all other countries occur by DHL. ILC is not responsible for the delivery time executed by these delivery carriers. The delivery charges withing the European Union are free of charges. The delivery charges outside de European Union are 4,95 EUR (incl. VAT).

 

Our products are handmade in Belgium and are made-by-order. This means that it might be possible that raw materials are not available at ILC nv when receiving a Customer’s order. In that case the delivery time can be longer than the target delivery time of 3 to 5 working days after receipt of the order that ILC is aiming at.

 

Any visible damage to and/or qualitative deficiencies of an article or other deficiency in the delivery must be reported immediately by the Customer to ILC nv.

 

The risk due to loss or damage is transferred to the Customer at the time the goods have been physically received by the Customer (or a third party indicated by the Customer that is not the carrier). However, the risk transfers to the Customer upon delivery to the carrier when the carrier received the commission to transport the goods and this option was not offered by ILC nv.

 

Article 6: Right of withdrawal

The provisions of this article apply only to Customers who purchase items online from ILC in their capacity as Consumers.

 

If the right of withdrawal applies:

 

The Customer has the right to withdraw from the contract within a period of 30 calendar days.

 

The withdrawal period shall expire 30 calendar days from the day on which the Customer or a third party other than the carrier designated by the Customer acquires physical possession of the goods.

 

To exercise the right of withdrawal, the Customer must notify ILC nv in writing by post to Leegaardsdijk 8, 8400 Oostende Belgium or by e-mail to sales@lic-leather.com in an unambiguous statement about their decision to withdraw from the agreement and the reasons why. The Customer may also use the online form that can be found in the FAQ section on the website www.lic-leather.com under the question "how do I return a product". 

 

To comply with the withdrawal period, the Customer must send a notification of their decision to exercise the right of withdrawal before the withdrawal period has expired.

 

In any event, the Customer has no later than 30 calendar days from the day that they notify ILC nv of their decision to withdraw from the agreement to send back or hand over the goods to ILC nv, Leegaardsdijk 8, 8400 Oostende Belgium. The Customer is on time if they have sent back the goods before the period of 30 calendar days has expired. The direct costs for returning the goods shall be borne by the Customer.

 

Returns may not be worn and must be in the same condition as when you received the products. All returned products are inspected by our master craftsmen to ensure the perfect condition of the strap. When a watch strap is fitted to your watch and you wear it, even just once, it is considered as used making it impossible for us to offer it to someone else through our webshop and hence we do not accept a return in that case. Only articles that are returned in the original packaging, along with all accessories, instructions and invoice or sales receipt are accepted to be returned.

 

Upon receipt by ILC nv, the returned items will be analyzed by the Seller. If the goods are in perfect state, ILC nv will proceed with the reimbursed within 30 days after reception of the returned goods.

 

Note that the shipping costs are non-refundable. If you receive a refund, the cost of shipping will be deducted from your refund. Next to this, a payment processing fee and handling fee of 5,00 EUR will be deducted from the purchase price.

 

ILC shall repay the Customer using the same means of payment as the Customer used in the initial transaction, unless the customer explicitly agreed otherwise.

 

The Customer may not exercise the right of withdrawal for the delivery of custom-made goods manufactured according to the Customer’s specifications or that are clearly destined for a specific person.

 

Article 7: Guarantee

The consumer has certain legal rights under the Act of 21 September 2004 concerning protection of consumers when purchasing consumer goods. This statutory guarantee applies from the date of delivery to the first owner. These rights remain in force irrespective of any commercial guarantee.

 

To make a claim under the guarantee, the Customer must provide a proof of purchase. Customers are advised to retain the original packaging used for the goods.

 

For articles purchased online and are delivered to the home of the Customer, the Customer must contact the ILC customer service and to return the product at their own expense to ILC nv.

 

Upon detection of a deficiency, the Customer must inform ILC nv as soon as possible. In any case, any deficiency must be reported by the Customer within 30 days after receiving the goods. Hereafter, all rights to repair or replacement are voided.

 

The guarantee is never applicable when there are deficiencies that arise as a result of accidents, neglect, falls, use of the product inconsistent with the purpose for which it was designed, failure to follow the operating instructions or manual, modifications or alterations to the article, rough usage, poor maintenance, or any other abnormal or incorrect use for example (non-exhaustive) related to the product having being in contact with water.

 

Deficiencies that manifest after a period of 30 days period from date of delivery to the Customer, shall be deemed to not be hidden deficiencies, subject to contrary evidence provided by the Customer.

 

Article 8: Customer service

ILC customer service can be reached by e-mail at sales@lic-leather.com . Any complaints can be made through the aforementioned customer services contact method.

 

Article 9: Privacy

The responsible party for processing information, ILC nv respects the Belgian law of 8 December 1992 regarding the protection of privacy in the processing of personal information.

 

The personal information you share with us is used only for the following purposes: ILC nv requires this information to understand Customer needs and provide the Customer with a better service, and in particular for the following reasons: internal record keeping. ILC nv may use the information to improve their products and services.

ILC nv may periodically send promotional emails about new products, special offers or other information which ILC nv thinks the Customer may find interesting using the email address which the Customer has provided.

From time to time, ILC nv may also use the Customer’s information to contact the Customer for market research purposes. ILC nv may contact the Customer by email, phone or mail. ILC nv may use the information to customise the website according to the Customer’s interests.

 

The Customer has a statutory right to access and eventually correct their personal information. Subject to proof of identity (copy of identity card), you may receive a free paper record of your personal information by sending a written, dated and signed request to ILC nv, Leegaardsdijk 8, 8400 Oostende Belgium. If necessary, Customers can also request the correction of information that is inaccurate, incomplete or irrelevant.

 

In the case when information is used for direct marketing purposes: Customers may preclude the use of their information for direct marketing purposes at no cost to themselves. To do so, Customers can always contact ILC nv in the aforementioned manner at Leegaardsdijk 8, 8400 Oostende Belgium.

 

ILC nv treats Customer’s information as confidential and shall not communicate, rent or sell it to third parties.

 

The Customer is responsible for maintaining the confidentiality of their login information and the use of their password. Your password is stored in encrypted form and thus ILC nv has no access to your password.

 

ILC nv saves online (anonymous) visitor statistics in order to determine which webpages are accessed on the internet website and to what extent.

Article 10: Use of cookies

A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system.

Article 11: Invalidation - non-relinquishment

If any provision of these Terms is declared invalid, illegal or void, it shall in no way affect the validity, legality and applicability of the other provisions.

 

Failure at any time by ILC to enforce any of the rights set out in these Terms, or to exercise any equivalent right, shall never be deemed as a waiver of such provisions and will never invalidate these rights.

 

Article 12: Amendments to the Terms

These Terms may be supplemented by other terms and conditions when explicitly referred to, and the general sales terms and conditions of ILC. In case of inconsistencies, the present Terms take precedence.

 

Article 13: Proof

The Customer accepts that electronic communications and backups shall serve as furnishing of proof.

 

Article 14: Applicable law - jurisdiction

Belgian law is applicable with the exception of the stipulations of private international law with respect to applicable law and with the exception of the Vienna Convention on the International Sale of Goods. Unless the Customer is a consumer, only the courts of Ghent, district Ostend (Belgium) have jurisdiction in the case of any disputes.
